A. Event Deposit / Cancellation Policy
Space for events will be held on a tentative basis until a signed agreement, non-refundable deposit and credit card number are received. The signed agreement and deposit must be received by the due date on the agreement. The non-refundable deposit amounts are noted on the issued agreement. Once received, all applicable terms will apply to your upcoming event. Your event will be considered definite, and all itineraries, details and setup requirements are needed by ArtsQuest.
Any additional payments will be calculated and a final deposit must be received within 3 business days prior to the function date. Assignment of space at any of the locations is based on anticipated attendance. Revisions to the number in attendance may necessitate moving your group to a more suitable space.
The host acknowledges and understands that ArtsQuest has made arrangements specifically for the date and time of the event contracted. All cancellations after a signed agreement has been received will incur a $50 cancellation processing fee.
The host will be subject to an additional cancellation fee for any event cancelled 2 weeks or less before the event. This fee will be 50% of the estimated charges for the event, including facility fee, staff fee, and audio visual equipment. The fee for cancellation within 7 business days is equal to 100% of the estimated charges for the event, including facility fee, staff fee, and audio visual equipment.
All events must be paid in advance based on the estimate from the guaranteed number given for facility fee, food, beverages, audio visual equipment, gratuity and taxes. The preferred method of payment is by a check made out to ArtsQuest, 25 W. Third St., Suite 300, Bethlehem, PA 18015-1238.
Any balances at the conclusion of the event must be finalized with ArtsQuest staff upon presentation of the final bill or the credit card number on file will be charged at the conclusion of the event.
ArtsQuest reserves the right to inspect all private functions held on the premises. This right includes setting the volume of entertainment and/or public address systems. Any damages to the property caused by function guests will be charged to the host. The host assumes responsibility for the actions of him/herself and guests, including payment for theft, damages or other liability.
ArtsQuest shall not assume any responsibility for damages or losses of any personal property displayed or stored on the premises. The facility will be returned to its original condition immediately following the event. Any equipment or materials left in the facility will be disposed of by ArtsQuest at the expense of the event host. All ArtsQuest facilities are non-smoking. Smoking is only permitted outside the building.
B. Insurance Requirements
The “Renter” will indemnify, defend (including attorney’s fees and costs) and hold harmless ArtsQuest (AQ) from and against any claim for personal injury or property damage arising out of “Renter’s” use of “AQ” facilities.
“AQ” requires all rental groups to supply a Certificate of Insurance specifying ArtsQuest named as an “Additional Insured.” The policy must show the organization is insured for a minimum of $1,000,000 (one million) bodily injury and property damage combined liability limit per occurrence during the time the events are to take place at the Banana Factory. The certificate must clearly show that the coverage period includes all setup and takedown times as well as the time of your event.
This certificate must be received and approved by “AQ” in advance of any planning or publicity of the event(s). If this certificate has not been received as of 1 week prior to the event date, “AQ” reserves the right to cancel the group’s reservation. The certificate should be mailed to The Banana Factory, 25 W. Third St, Bethlehem, PA 18015.
FAILURE TO PROVIDE THE CERTIFICATE OF INSURANCE WILL NECESSITATE OUR CANCELING YOUR EVENT.
